Extended DACA is currently on hold due to an injunction.  This means that no applications may be sent in at this time for this type of relief.  The original form of DACA is still available and you can see the qualifications for this type of relief here.

This is a program that was announced in June of 2012 granting temporary  protective  status and grants work permits to individuals who met certain criteria.  Some of the requirements have been modified due to the executive action taken by President Obama on November 21, 2014.  The new requirements to qualify for DACA are as follows:


  • Came into the U.S. prior to the age of 16
  • You must have continuously resided in the United States since January 1, 2010
  • You must have been present in the U.S. on November 20, 2014 and every day since then
  • You cannot currently have any lawful status, meaning that you cannot currently have a visa or any other type of lawful immigrant status
  • You must currently be in school, graduated from high school, or have a General Education Diploma (GED) at the time of your DACA application
  • You must not have been convicted of certain criminal offenses
  • Pass a background check
